This Privacy Notice sets out how we process your personal information through, and in connection with, this website and other websites we operate (“Sites”). “We”, “us” and “our” in this Privacy Notice refer to AdvisorArch, Inc., the company responsible for the collection of your personal information in connection with our Sites.

This Privacy Notice is intended to assist you in making informed decisions when using our Sites. Please ensure you read and understand this Privacy Notice. It sets out the types of personal information we obtain through the Sites, how we may use such personal information, with whom we may share it and the choices you may have regarding our use of that personal information. Data controller

Depending on where you reside and where relevant legislation applies, we act as the “data controller” of your personal information which we collect in connection with our Sites. SECTION 2:  TYPES OF PERSONAL INFORMATION WE COLLECT AND PROCESS

We may collect or obtain the following types of personal information through or in connection with our Sites:

  • Identity and Contact Information, such as first name, last name, delivery address, billing address, email address, phone number, and social media handle.
  • Behavioural Information, such as your browsing activity obtained through the use of cookies, pixel tags and other similar technologies, information about when your current or previous sessions started, and details about any services you viewed through our Sites.
  • Technical Information, such as IP address, browser type and operating system, geolocation, to ensure we are showing you the correct notices and information, and any other unique numbers assigned to a device.
  • Marketing and Communications Information, such as your marketing preferences, service communication preferences.
  • Information you provide to us, such as personal information provided via email correspondence or that you decide to provide on or through our Sites e.g., via a contact form.

We may collect or obtain your personal information in the following ways:

  • Personal information you voluntarily provide to us. You may give us your personal information directly, for example, when you inquire about our services through our Sites.
  • Personal information we collect using cookies and other similar technologies. When you access and use our Sites, we collect certain behavioural and technical data. We collect this personal information by using cookies and other similar technologies.
  • Personal information received from third parties. We may receive personal information about you from third parties such as affiliated entities and analytics providers so that we can provide our Sites.

We may collect or obtain your personal information in the following ways:

  • verifying your identity and respond to your inquiries, including requests regarding our products and services;
  • administering our Sites including providing various website functionality to you and diagnosing and resolving technical and service problems;
  • operating, evaluating, and improving our business, such as developing new products and services, managing our communications, determining the effectiveness of our sales, marketing and advertising, analyzing and improving our business, products and services and Sites, and performing accounting, auditing, billing, reconciliation and collection activities;

  • protect the rights, property or safety of us or third parties, including our other clients and users of the Site; and
  • additional purposes from time to time as otherwise required or permitted by law.

We may combine or aggregate any of the information we collect through our Website for any of these purposes.

SECTION 5:  HOW LONG WE KEEP YOUR PERSONAL INFORMATION We retain personal information only for as long as is necessary for the purposes described in this Privacy Notice, and as required by applicable legal, accounting or reporting requirements, after which it is deleted from our systems. If you have opted out of receiving marketing communications from us, we will need to retain certain limited personal information on a suppression list so that we know not to send you further marketing communications in the future.

SECTION 6:  SHARING YOUR PERSONAL INFORMATION

We only share personal information where we are legally permitted to do so. When we share personal information with others, we put appropriate safeguards and security arrangements in place to protect the personal information shared and to comply with our data protection, confidentiality and security standards and obligations.

Subject to the above, we may share your personal information with third parties, as set out below. This list is non-exhaustive and there may be circumstances where we need to share personal information with additional third parties:

  • Third parties who perform services on our behalf, such as, web applications, data processing and IT services. These third parties are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements.
  • Law enforcement or other government and regulatory agencies and bodies, if we are required to do so by law or legal process, based on a lawful disclosure request, or when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity.
  • Auditors, lawyers, accountants and other professional advisers, as required by, and in accordance with, applicable law or regulation.

Affiliates, service providers, advisors, and other third parties to the extent reasonably necessary to proceed with the negotiation or completion of a merger, acquisition, or sale of all or a portion of our assets

We strive to maintain reasonable administrative, technical, and physical safeguards designed to safeguard the information we collect.  Please note that due to the inherent open nature of the Internet, we cannot guarantee that all information will be free from unauthorized access by third parties, such as hackers, and by accessing or using our Sites, you accept this risk

Depending on where you reside and where relevant legislation applies, we may require a legal basis to process your personal information. In such cases, we will rely on one of the following legal bases:

  • Right to Access. To obtain the confirmation that we process personal information about you, to access and obtain copies of the information, as well as information relating to the processing we carry out.
  • Right to Rectify. To request your personal information be updated or corrected where appropriate.
  • Right to Delete. To request your personal information be deleted, where appropriate.
  • Right to Restrict Processing. To request that we restrict the processing of your personal information in some circumstances, such as where you contest the accuracy of the personal information, while we investigate your concern.
  • Right to Data Portability. To receive your personal information in a commonly used electronic format, including that we transfer your personal information in that format directly to another person.
  • Right to Object. To object to certain types of processing, such as, direct marketing, profiling, and for purposes of scientific or historical research and statistics.
  • Right to Withdraw Consent. To withdraw your consent at any time when the processing relies upon consent (such withdrawal shall not affect the lawfulness of our processing of your personal information based on consent before its withdrawal).
  • Right to complain to a supervisory authority or other regulator. You may have the right to lodge a complaint with a supervisory authority or other regulator, for example in the country in which you reside, place of work or where the alleged infringement took place. We ask that you contact us in the first instance to attempt to resolve your complaint before you complain to a supervisory authority or regulator.

SECTION 10:  THIRD PARTY LINKS AND SERVICES  

Our Sites may contain links to third party websites and services. Please remember that when you use a link to go from our Sites to another website or you request a service from a third party, this Privacy Notice no longer applies to these third-party websites and third-party service providers.

Our Sites may integrate with social networking services. You understand that we do not control such services and are not liable for the manner in which they operate.  While we may provide you with the ability to use such services in connection with our Sites, we are doing so merely as an accommodation and, like you, are relying upon those third-party services to operate properly and fairly.

SECTION 11:  PERSONAL INFORMATION OF MINORS  

Our Sites are not intended for use by, or targeted at, minors (individuals under the age of 18) and we do not knowingly collect personal information of minors. If we discover that we are holding the personal information of a minor, we will delete that information as soon as possible. If you are a parent or legal guardian of a minor, please contact us if you have reason to believe that such minor may have submitted their personal information to us.

This Privacy Notice will be updated periodically and without prior notice to you to reflect changes in our personal information practices. We will post a prominent notice on our Sites to notify you of any significant changes to our Privacy Notice and indicate at the top of the Privacy Notice when it was most recently updated.

SECTION 14:  COOKIES AND SIMILAR TECHNOLOGIES   

When you visit our Sites, we may collect certain information by automated means, such as cookies, web beacons and similar technologies.

What are cookies and similar technologies?

Cookies are very small text files or pieces of code, which often include a unique identifier. When you visit a website, the website will request to store this text file on your device in order to remember information about you, such as your language preference or login information.  Other information gathered through cookies may include the date and time of visits and how you are using the particular website.

Ed has 30 years of technology experience including 18 years as a director and Bloomberg LP, a leading financial data and analysis platform. He holds an MS from Temple University and a BA from Rutgers University where he graduated with honors.

Rob is the Founder & Co-Chief Executive Officer of AdvisorArch. Prior to AdvisorArch, he was the Chief Investment Officer at RobustWealth and was responsible for the development and implementation of RobustWealth’s investment strategy.

Rob has 25 years of investment experience including 16 years as a managing director for the CooperNeff Group, a multi-strategy alternatives company. During his tenure at CooperNeff, Rob was responsible for a global multi-billion dollar process trading operation that was comprised of a staff of 50 professionals. He holds an MBA from Wharton where he graduated with honors. Rob also served on the board of Archipelago, an electronic trading platform that was subsequently acquired by the New York Stock Exchange.

Mike Kerins

Mike Kerins is the Co-Chief Executive Officer and co-founder of AdvisorArch. Prior to AdvisorArch, Mike founded RobustWealth in 2015. Principal Financial Group acquired RobustWealth in 2018 and Mike was CEO of RobustWealth until 2021. Mike spent eight years at Franklin Templeton, where he managed an investment team overseeing a global portfolio of assets equaling $40 billion. He also served as the head of asset class research and has expertise spanning strategic and tactical asset allocation, portfolio construction, target date strategies and liquid alternatives.

Mike is a CFA® charter holder as well as a certified Financial Risk Manager. He holds a B.S. in Finance and a B.S. in Chemical Engineering from the University of Colorado and has a certificate in Computational Finance from the University of Washington.
